Terms and Conditions ARMYCARPARTS.COM
By placing an order, the customer acknowledges agreement with the general terms and conditions (including delivery and payment terms) of ARMYCARPARTS.COM.
ARMYCARPARTS.COM reserves the right to amend these terms. The amended terms take effect once the customer places a new order, signifying acceptance of the revised conditions. Any general terms from customers are expressly rejected.
Article 1 General
1.1 In these terms and conditions, "customer" refers to the (potential) customer of products and/or services provided by ARMYCARPARTS.COM.
1.2 These general terms are public and accessible to everyone under "General Terms" on the ARMYCARPARTS.COM website. At the customer's request, JEMAX-PARTS will send a copy by mail.
1.3 These terms apply to all offers, orders, and agreements between the customer and ARMYCARPARTS.COM.
1.4 All rights and claims established in these terms and any other agreements benefiting ARMYCARPARTS.COM also apply to intermediaries and third parties engaged by ARMYCARPARTS.COM.
1.5 Deviations from these terms are only valid if explicitly agreed upon in writing with ARMYCARPARTS.COM.
1.6 If any provision of these terms is nullified or annulled, the remaining provisions remain fully valid. ARMYCARPARTS.COM and the customer will then agree on a new provision that closely aligns with the intention and purpose of the original provision.
1.7 ARMYCARPARTS.COM reserves the right to amend these terms and the content of its website (ArmyCarParts.com.nl) at any time.
Article 2 Offers and Agreements
2.1 All offers made by ARMYCARPARTS.COM are binding unless a human error, typographical, or spelling mistake is clearly present. ARMYCARPARTS.COM reserves the right to modify or withdraw offers at any time. All offers are subject to availability.
2.2 ARMYCARPARTS.COM's records serve, barring evidence to the contrary, as proof of customer orders and payments made. ARMYCARPARTS.COM recognizes that electronic communication can serve as proof, and by accepting these terms, the customer acknowledges this.
Article 3 Prices, Rates, and Payment
3.1 All prices for offered goods are in Euros, including VAT and other government-imposed levies, but excluding delivery costs unless otherwise stated or agreed in writing, and subject to price changes.
3.2 If payment is made via PayPal, IDEAL, or other payment organizations, the transaction fee charged by these services will be passed on to the customer.
3.3 If payment is reversed, the agreement is considered void, and the goods delivered to the customer remain the property of ARMYCARPARTS.COM. The cost and risk of returning the goods to ARMYCARPARTS.COM are borne by the customer unless agreed otherwise in writing.
3.4 If the customer defaults on payment, ARMYCARPARTS.COM reserves the right to charge all collection costs to the customer.
3.5 If the customer fails to fulfill the payment agreement, ARMYCARPARTS.COM is entitled to terminate the contract immediately or suspend its obligations.
3.6 All goods delivered to the customer remain the property of ARMYCARPARTS.COM until full payment is received.
3.7 Delivered goods or services must be paid for within thirty days of the delivery date unless otherwise explicitly agreed in writing.
Article 4 Deliveries / Delivery Times
4.1 Products (parts) are generally shipped within 24 hours and no later than 10 business days unless otherwise agreed upon when the contract is made.
4.2 Delivery times provided by ARMYCARPARTS.COM should not be considered final unless explicitly stated otherwise.
4.3 If ARMYCARPARTS.COM unexpectedly exceeds the agreed delivery time, it will inform the customer immediately, offering the option to cancel the agreement or agree on a new delivery time. Payments made will be refunded within 30 days upon cancellation.
Article 5 Right of Return for Distance Purchases
5.1 If the customer is dissatisfied with a purchased product, they have the right to return it within 7 days of delivery. The customer can return the order without giving a reason and will be refunded the purchase price. Return shipping costs are borne by the customer. The product must not be used or damaged and must be resaleable.
5.2 Before returning items, the buyer must notify ARMYCARPARTS.COM, preferably via email at [email protected]. The purchase amount will be refunded within 30 days (if already paid).
5.3 The right of return does not apply to custom orders.

Article 6 Force Majeure and Other Special Circumstances
6.1 ARMYCARPARTS.COM is not obliged to fulfill any obligation to the customer if prevented by circumstances beyond its control, whether due to law, legal action, or commonly accepted social norms.
Article 7 Risk and Liability
7.1 Transport of the ordered product by third parties is at the customer's risk. ARMYCARPARTS.COM is not liable for damage resulting from using the delivered items or any actions or omissions by ARMYCARPARTS.COM.
7.2 ARMYCARPARTS.COM is not liable for injury or damage of any kind to the customer or third parties.
7.3 The customer indemnifies ARMYCARPARTS.COM against all claims for compensation by third parties, which the latter may bring against ARMYCARPARTS.COM on the basis of any act or omission on the part of ARMYCARPARTS.COM.
7.4 Notwithstanding any provisions elsewhere in these general terms and conditions, ARMYCARPARTS.COM is liable if a failure to fulfill an obligation towards a customer is due to its intent or gross negligence, or is deemed to be the responsibility of ARMYCARPARTS.COM by law, legal act, or common opinion.
7.5 Defects to the customer's vehicle caused by incorrect assembly work carried out by ARMYCARPARTS.COM will be repaired free of charge by ARMYCARPARTS.COM.
7.6 If ARMYCARPARTS.COM is liable for damage, it is entitled to repair the damage at its own expense. If the customer chooses to have the damage repaired by a third party, ARMYCARPARTS.COM is only obligated to reimburse the cost up to the amount that would have been incurred had the customer allowed ARMYCARPARTS.COM the opportunity to repair (or have repaired) the damage.
7.7 In the case of damage resulting from ARMYCARPARTS.COM's liability, ARMYCARPARTS.COM is only liable for direct damages. ARMYCARPARTS.COM is not liable for any consequential damage of any kind, unless it involves intent or gross negligence.
7.8 In the case of damage resulting from ARMYCARPARTS.COM's liability, ARMYCARPARTS.COM is only liable for damage to cars entrusted to it, parked on ARMYCARPARTS.COM’s premises. ARMYCARPARTS.COM is not liable for damages incurred outside its premises or for damage caused while the customer is driving the vehicle.
7.9 In all cases, the liability of ARMYCARPARTS.COM is limited to the amount paid by its insurance, provided the damage is covered by the insurance, or the liability is limited to the original invoice amount.
Article 8 Orders/Communication
8.1 ARMYCARPARTS.COM cannot be held liable for misunderstandings, damages, delays, or unclear communications in orders and communications due to the use of the internet or any other communication medium between the customer and ARMYCARPARTS.COM, or between ARMYCARPARTS.COM and third parties, insofar as these concern the relationship between the customer and ARMYCARPARTS.COM.
Article 9 Products/Services/Complaints
9.1 ARMYCARPARTS.COM guarantees that the products it supplies are sound and meet the standards expected in commercial trade for such goods.
9.2 Unless otherwise specified at the time of sale, the quality and type are delivered in accordance with standard commercial practices in the applicable sector and are considered to have been agreed upon.
9.3 ARMYCARPARTS.COM will perform the service requested by the customer to the best of its ability.
9.4 All complaints regarding delivery, product quality, condition, or any other complaint will be taken seriously and handled by ARMYCARPARTS.COM within a reasonable timeframe. Preferably, complaints should be sent by email to [email protected]. ARMYCARPARTS.COM will make every effort to resolve the complaint satisfactorily.
9.5 Complaints regarding incorrect deliveries (e.g., if different items than those ordered have been delivered) must be reported by the customer within seven days of receiving the order.
9.6 ARMYCARPARTS.COM will discuss the return process with the customer. If the customer returns the order, the order amount will be refunded as soon as the returned goods are received in good condition at ARMYCARPARTS.COM's warehouse.
9.7 If a product is returned that, in ARMYCARPARTS.COM’s judgment, has been damaged due to the customer’s actions or negligence or for any other reason attributable to the customer, ARMYCARPARTS.COM will inform the customer via letter, fax, email, or telephone. ARMYCARPARTS.COM reserves the right to deduct the depreciation of the product due to such damage from the refund amount.
9.8 For product-related complaints, the customer must contact ARMYCARPARTS.COM within seven days of the delivery date.
9.9 The nature of the complaint will be determined in consultation with the customer. If the complaint is justified, the order amount for the product in question will be refunded, or a replacement product will be provided.
9.10 Any complaints after the delivery of services must be reported to ARMYCARPARTS.COM within seven days of the service delivery unless a longer period is applicable under Article 7:23 of the Dutch Civil Code.
9.11 If the customer does not make a complaint within the period specified in Article 13.1, the delivered service will be considered satisfactory.
9.12 Any damage discovered by the customer on their vehicle, which they believe was caused during services performed by ARMYCARPARTS.COM, must be reported by the next business day after the customer has collected the vehicle from ARMYCARPARTS.COM.
9.13 ARMYCARPARTS.COM is not liable for damage reported after the period specified in Article 9.12, unless ARMYCARPARTS.COM expressly acknowledges such liability in writing.
Article 10 Repair, Assembly, or Replacement Orders
10.1 Orders given to ARMYCARPARTS.COM for repair, assembly, or replacement do not include the replacement or renewal of parts that are only found to need replacement after disassembly or the repair of defects discovered upon disassembly and deemed necessary or advisable for repair.
10.2 ARMYCARPARTS.COM will only carry out additional repairs or replacements as described in Article 10.1 after obtaining the customer’s consent.
10.3 ARMYCARPARTS.COM is entitled to use the services of third parties to perform the repairs, assembly, or replacement in whole or in part on behalf of ARMYCARPARTS.COM.
10.4 ARMYCARPARTS.COM is not liable for damage to a vehicle or its parts if such damage results from necessary measures taken by ARMYCARPARTS.COM to perform repairs, assembly, or replacement, unless the damage is due to intent or gross negligence on the part of ARMYCARPARTS.COM.
Article 11 Warranty
11.1 Unless otherwise specified, ARMYCARPARTS.COM grants, without prejudice to the rights or claims granted to the customer by law, a twelve-month warranty on the work performed and the parts supplied by it. ARMYCARPARTS.COM will ensure, free of charge, the repair or correction of defects related to the materials used or the execution of the work for a period of twelve months after the repair or delivery of a replacement part.
11.2 A different warranty period may apply to certain products.
11.3 Warranty work will be carried out in and from the workshop of ARMYCARPARTS.COM. Any transportation costs are at the customer's expense.
Article 12 Chamber of Commerce
12.1 ARMYCARPARTS.COM is registered with the Chamber of Commerce in ‘s-Hertogenbosch under the Chamber of Commerce number 55726984 Army Car Parts.
Article 13 Applicable Law and Dispute Resolution
13.1 All offers, orders, and agreements of ARMYCARPARTS.COM are governed by Dutch law.
13.2 Disputes between ARMYCARPARTS.COM and the customer will be submitted to the competent Dutch court in 's-Hertogenbosch.
